These terms of use (the “Terms”) for Belfius Bank Open Banking Developer Portal (the “Portal”) are intended for testing purposes of applications (Application Programming Interfaces – “API’s’). These Terms do not apply in relation to the API’s for account information services, payment initiation services or card based payment instruments services as defined under Belgian law, implementing the Payment service directive (EU)2015/2366 (“PSD2”) and offered to payment service providers allowed under applicable law to provide such services.

The Belfius Bank Open Banking Developer Portal creates a Sandbox environment (“Sandbox”). Your access to and use of the Belfius Bank Open Banking Developer Portal are subject to the following Terms. By accessing and using the Portal, the user acknowledges that he has read, understood and accepts these Terms. Additional terms and registration requirements may apply to specific API’s.

Users may use the Sandbox, in order to test functionalities and features of their payment applications by using test data and data field structures provided by Belfius Bank. Mere user registration to the Portal does not constitute a right to access to piloting with real customer data without express consent of Belfius Bank.

Belfius Bank may, at any time, suspend or terminate your right to access or use the information in case you violate these Terms.

Belfius Bank may at any time adapt these Terms or any additional terms that apply to specific API’s available through the Portal. Changes will be published on the Portal and will become immediately effective.

These Terms, any additional terms applicable to a specific API and the use of the Portal and its content are governed by the laws of Belgium. You hereby submit to the exclusive jurisdiction of the court in Brussels.

Specific terms

By registering as a user of the Portal (developer.belfius.com), hence using the Sandbox, you acknowledge and agree that:

• The information you provided to Belfius Bank in order to use the Sandbox is accurate.
• You will comply with all legal requirements and refrain from creating content that is unlawful or otherwise objectionable, or that may harm Belfius Bank’s reputation or the integrity of the financial system.
• Belfius Bank provides information and other materials in Sandbox on an “as is” basis without any warranty of any kind, whether express or implied, including without limitation fitness for a particular purpose and non-infringement of third party rights. The information and functionalities may be subject to changes and do not constitute a binding commitment to implement services or specific technical or functional details to the services.
• Unless otherwise informed Belfius Bank owns all rights, title, interest and intellectual property rights in Sandbox applications, functionalities and related information on the site, including the right to copy, amend, modify, develop, sublicense, sell and assign such rights. Belfius Bank is providing, upon successful registration, a limited, non-exclusive, non-transferable, revocable and non- sublicensable license to use the information and related API’s for the user to test and assess the feasibility of, and the user’s interest in, using Belfius Bank’s API’s. This licence is for the sole purpose of enabling you to use the functionalities of the Portal in accordance with these Terms.
• Use of Sandbox does not constitute any transfer of user’s intellectual property rights to Belfius Bank. The latter may however, use the feedback submitted to Belfius Bank to improve and develop its services.
• As a user you agree not to (i) reverse engineer, reverse compile, decrypt, unmask, or reverse assemble the Sandbox or any data accessible via Sandbox; or (ii) distribute, disclose, publish, market, sell, rent, lease, sublicense or assign to any third party any information to which you have access via Sandbox without prior express consent of Belfius Bank.
• Belfius Bank has no direct or indirect liability related to, or arising from, use of the information, including use of the software or specifications released in Sandbox. You will indemnify Belfius Bank against any direct, indirect and/or consequential loss, damage, cost and expense (incl. legal expenses) incurred by Belfius bank and arising from your use of the Portal.
• The trademarks, service marks and logos of Belfius Bank on the Portal are the property of Belfius Bank. You are prohibited from using any of the marks without the prior written consent of Belfius Bank.

Privacy

Belfius Bank’s privacy policy is described in the Belfius Bank Privacy Charter, which can be read on www.belfius.be.

Cookies

Belfius Bank uses cookies for supporting operation and functionalities of the website, such as technical operation of the website to ensure it performs as expected. Cookies are used to track users across our websites. They can be used to build up a profile of search and/or browsing history for every user. Identifiable or unique data may be collected. Anonymized data may be shared with third parties. Cookies are used to support your experience on the site and include user-selected options, site navigation aids, etc. Generally, no personally identifiable data is collected with these types of cookies.
